NAV CANADA Informed of Appeal

(Ottawa, August 22, 2003) - NAV CANADA today announced that it has been informed by the Canadian Transportation Agency (CTA) that the Agency has received an appeal by Air Canada of the revised charges NAV CANADA instituted on August 1, 2003. The CTA is the designated appeal body for NAV CANADA charges pursuant to the provisions of the Civil Air Navigation Services Commercialization Act.

After considering the submissions of both Air Canada and NAV CANADA, the CTA must decide the matter within 60 days, unless the Agency is of the opinion that there are special circumstances involved in the determination of the appeal, in which case the Agency has a further 30 days to decide the appeal.

In the meantime, the new rates implemented on August 1, 2003, which represent an average 6.9 per cent increase along with certain changes to credit terms, will remain in effect.

"NAV CANADA intends to oppose the appeal," said Neil Wilson, Vice President, General Counsel and Corporate Secretary, NAV CANADA.

NAV CANADA, the country's provider of civil air navigation services, is a non-share capital, private corporation with operations coast to coast providing air traffic control, flight information, weather briefings, aeronautical information, airport advisory services and electronic aids to navigation.
